In that case, surely, mere coincidence would not do as an answer to our question. So too, our efforts would not count as successful if the answer to our question were fear of sanctions, or that the agent had been programmed (by means of rote memorization) or had mechanically applied the rule to the situation at hand. Having placed an act in an appropriate category of wrongs sets the stage for a syllogistic/mechanical handling of the case: All acts in category 1 are wrong. This act falls into the first category.

All are forbidden. But this last, unlike the others, is not simply a duty to refrain from action. If I were to look the other way or say nothing, I would be tolerating forbidden conduct, but that is forbidden. So, I can’t look the other way or say nothing; I am duty bound not to do that. 4 This is where the rubber meets the road, not only because this is the juncture where, in trying to institute or administer an honor code, one is likely to meet with resistance, but also because it raises in a forceful way what is in the end the key question ethically.

The problems in the mechanical jurist’s conception of adjudication are similar to the problems associated with what might be called a ‘geo-syllogistic’ (mis)conception of ethics. Both are, to stick with similes from Greek myth, like the siren’s song in being difficult to resist and dangerous. The best evidence that these misconceptions are difficult to resist is how widespread they are. And the sense in which they are dangerous, or at least deeply problematic, emerges when, for example, we try to teach ethics across the curriculum or reveal the ethical dimensions of an institution’s concern with academic integrity.
